This Privacy Statement (“Statement“) shall hereby inform you of legal rights and responsibilities with respect to the collection and use of personal information via the websites and mobile applications of eGarage.com (the “Service“). Your access and use of the Service shall indicate your agreement to be legally bound by the terms contained henceforth in this Privacy Policy.

PLEASE REFRAIN FROM ACCESSING OR USING THE SERVICE IF YOU ARE UNWILLING OR UNABLE TO BE BOUND BY THE FOLLOWING TERMS.

1. DEFINITIONS
A. Parties
You” and “your” refer to you, a user of the Service. A “user” is someone who accesses, browses, crawls, scrapes, or in any way uses the Service. “We“, “us“, and “our” refer to eGarage.

B. Content
“Content” means text, images, photos, audio, video, location data, and all other forms of data or communication. “Your Content” means Content that you submit or transmit to, thru, or in connection with the Service, (e.g. ratings, reviews, compliments, invitations, check-ins, messages, or other information that you publish intentionally or not). “User Content” means Content that any user submits or transmits to, thru, or in connection with the Service. “eGarage Content” means Content that we create and make available in connection with the Service. “Third Party Content” means Content that originates from parties other than eGarage or its users, which is made available in connection with the Service. “Site Content” means all of the collective Content that is made available in connection with the Service, including Your Content, User Content, Third Party Content, and eGarage Content.

C. Use
“Use” means to use, copy, publicly perform or display, distribute, modify, translate, or create derivative works of.

2. INFORMATION WE COLLECT AND HOW WE USE IT
Account information. The Service requires certain about you information (name, email address, and signup location for example) to register an account; you may elect to import account information from third parties during account registration. Your name establishes your account; location data may be used to tailor search results specific to your area of residence; and your email address is used for communications. The information you register an account with may be used to display relevant advertising to you.

Published content. The Service allows you to post comments, upload photos, participate in talk threads, create public profiles, and vote on user contributions. We may store Your Content, display it to other users, and/or use it for promotional purposes. Note that if you include personally identifiable information in Your Content, it can be used and viewed among the Site Content by other users. You assume all risk for the information you choose to include in Your Content.

Location data. The Service may provide information specific to users’ geographical location. If you tell us where you are (e.g. by providing zip code information), we may store and use such information to provide you with location-based information and advertising.
Third party services. Users may access third party services, such as Facebook and Twitter, to share selected Public Content with those services, and import information about a user’s “friends” to also connect with them through the Service.
Mailing lists. Users may choose to sign up for a mailing list. In order to receive regular emails from a site’s mailing list, users must submit information including a valid email address and demographic information such as location and interests. This information will be used in aggregate form only in order to assess general user interest in various internal and third party products and services. Personal and contact information will not be passed to any other organization. If you do not wish to receive emails from third party advertisers, please do not sign up for mailing lists.
Activity and log data. We may store information via a tracking utility that uses log files to analyze user movements related to the Service, (e.g. pages viewed, browser type, IP address, contact information of businesses communicated with via the Service, URL requests, date/time stamps, etc.). These data are not linked to personally identifiable information; it is only gathered for the purpose of administrating the Service to provide you the best possible user experience.
Cookies and Similar Processes. We collect information from users of our Service via “cookies,” “web beacons,” “clear gifs,” Internet Protocol (“IP”) addresses, and other computer programs or processes to uniquely identify your browser and improve the quality of our service. Cookies are small data files that are transferred to your computer by servers. Web beacons are small electronic images (usually single-pixel “gif” files) that allow access to cookies. Clear gifs are invisible electronic images. IP addresses are unique sets of numbers assigned to computers that are accessing the Internet. We or third parties may use and access these programs or processes in order to improve content offerings by, for example, customizing content. These data will be aggregated and absent any personally identifiable information. If you wish, you may elect to configure your browser to prevent websites from installing and accessing cookies on your computer. Please note that blocking cookies will interfere with your use and enjoyment of the Service.

Feedback. You should feel free to offer feedback, register a complaint, or ask questions regarding the Service. We may store your communications, including any personal information you include in them, so that we can effectively respond to you.

Administration. We may use any of the aforementioned information for routine administrative purposes, such as investigating abuses on the Service, responding to user inquiries, and enforcing and applying our Terms of Service and Statement.

Data storage. Our data is stored within the United States.

3. TRANSFER OF INFORMATION
Public Content. Information voluntarily disclosed (for example, by sending an email or posting to a message board or chat room) is available to the public. We assume no responsibility for removing or preventing the disclosure of private information in those areas of our Service. You should exercise caution when publishing personal information. If Your Content is published for public view on the Service, we may distribute any personally identifiable information that accompanies the Site Content to a wider audience by sharing it (or portions of it) with third parties.

Third party service providers. We may use third parties to provide technical and customer support, perform tracking and reporting functions, conduct quality assurance testing, perform payment processing, and/or provide other services in connection with the Service. We may share information with them so that they can perform their services. Third party services providers shall not use user’s personal information; however, if you voluntarily elect to receive information from a third-party vendor, we will forward that request to the vendor along with the personal information that users submit.

Third party advertising. Third parties serve some of the ads found within the Service. We do not send any individualized personal information to them, but they may have access to information that they obtain through cookies or that you share with them yourself. Note that we do not rent, share, sell or trade personally identifiable information with third parties for their direct marketing purposes.

Aggregate information. We may share aggregated, non-personal information relating to user behavior with third parties such as advertisers and content distributors. For example, we may disclose the number of advertising banners that users have been exposed to or clicked on.

Business transfers. We may share your information with our parent company, subsidiaries, joint ventures, or other companies under a common control that we may have now or in the future, in which case we will require them to honor this Statement. If another company acquires our company, or all or substantially all of our assets, that company will possess your information, and will assume the rights and obligations with respect to that information as described in this Statement.

Investigations. We reserve the right to investigate abuses of the Service, and enforce and apply our Terms of Service and Privacy Statement. We may disclose information about you to third parties if we have a good faith belief that such disclosure is reasonably necessary to (a) take action regarding suspected illegal activities; (b) enforce or apply our Terms of Service and Privacy Policy; (c) comply with legal processes, law enforcement instructions, and orders served on us; or (d) protect our rights, reputation, and property, or that of our users, affiliates, or the public.

4. MANAGING YOUR INFORMATION
We provide a number of tools to help users manage user information on the Service. We also maintain physical, electronic, and managerial procedures to safeguard and prevent unauthorized access to private information in our possession. However, these procedures may not protect your information during transmission to our servers.

5. LINKS
The Service may contain links to third party websites that are not affiliated with eGarage. Except as set forth herein, we do not share your personal information with those third parties, and are not responsible for their privacy practices. We encourage our users to be aware when they leave our site, and to read the privacy statements of each and every Web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by the eGarage.

6. POLICY TOWARDS CHILDREN
Children under 13 may not fully understand the consequences of submitting personal information on our websites. Therefore the Service is intended for general audiences and is not directed to children under 13. Parents are encouraged to supervise the online activities of their children and educate them on responsible use of the Internet. We do not knowingly collect personal information from children under 13. If you become aware that your child has provided us with personal information without your consent, please contact us. If we become aware that a child under 13 has provided us with personal information without parental consent, we take steps to remove such information and terminate the child’s account.

7. SECURITY
We acknowledge that no method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

8. DISCLAIMER
This Privacy Policy applies only to the services owned or operated (solely or in conjunction with our production partners) by eGarage LLC. Any third-party websites linked from the Service (via banner advertisements, etc.) are not governed by this Privacy Policy, and we assume no responsibility for the collection, use, disclosure, or protection of personal information taken by those sites.

10. MODIFICATIONS TO THIS STATEMENT
This Agreement may be modified from time to time. The date of most recent modification will be included herein; any such modification is effective and binding upon publication. Please revisit this Agreement on a regular basis as subsequently revised versions will legally bind you.

YOU UNDERSTAND AND AGREE THAT CONTINUING TO ACCESS AND USE OF THE SERVICE, SUBEQUENT TO ANY NEW OR MODIFIED PROVISIONS TO THIS AGREEMENT, INDICATES THAT YOU ACCEPT ANY SUCH PROVISION.
